In these terms, the following definitions apply:
Cooling-off period – the period during which the consumer may exercise the right of withdrawal/returns.
Consumer – a natural person who purchases goods for personal use, not for business purposes.

Long-term contract – an agreement for recurring supply of products and/or services over a set period.
Durable data carrier – any tool that allows information to be stored for future reference unchanged.
Right of withdrawal / return right – the consumer’s right to return goods during the cooling-off period.
Trader – Palm Grace Boutique or any legal entity offering products to consumers online.
Distance contract – a contract concluded online without physical presence of the trader and consumer.

These terms apply to all offers made by Palm Grace Boutique and to every online purchase made by a consumer in Australia.
Before completing an order, the consumer has access to these terms. For online purchases, they are provided in a format that can be stored.
If specific product terms apply, the most favourable condition for the consumer prevails in case of conflict.
If an offer is valid for a limited time or under certain conditions, this will be clearly mentioned.
All offers are non-binding and may be modified.
Product descriptions are made as accurately as possible. Obvious errors or typos are not binding.
Images are for illustrative purposes and may differ slightly in colour or appearance.
Each offer includes clear details about:
the total price including GST (if applicable),
any additional costs such as shipping (if applicable),
how the contract is concluded,
the return policy,
delivery times,
payment terms,
contract duration (if relevant).
A contract is created once the consumer completes the order and meets the conditions.
For online purchases, the consumer receives an order confirmation by email. Until this confirmation is received, the consumer may cancel the order.

Where necessary and legally permitted, we may verify payment ability. Orders may be refused or additional conditions required based on this assessment.
Upon delivery, the consumer receives:
contact details for complaints,
return policy information,
warranty conditions,
the information stated in Article 4 (if not already provided).
Consumers in Australia have 30 days from the date of delivery to return an item for any reason.
During this period, consumers must handle the product and packaging with care. Items may be tried on, but not used beyond what is necessary to check fit and condition.
If the consumer wishes to return an item:
the product must be returned within 30 days,
in its original condition and packaging,
with all accessories included.
Returns are processed in accordance with Australian Consumer Law (ACL), guaranteeing consumer rights regardless of these terms.
Return shipping costs are the responsibility of the consumer.
Palm Grace Boutique will refund the purchase price as soon as possible and no later than 14 days after receiving the returned goods or receiving proof of shipment.
The right to return does not apply to:
personalised or custom-made items,
products with a personal character,
products that cannot be returned for hygiene reasons once opened (e.g. underwear, swimwear without hygiene seals),
items damaged due to misuse.
If an item falls under an exception, this will be clearly stated in the offering.
These exceptions do not affect rights under Australian Consumer Law.
All prices are listed in AUD or converted at checkout, including GST where applicable.
During promotional periods, prices will not increase unless required by law.
Price increases within 3 months of purchase are not permitted unless required by legal changes.
Price adjustments after 3 months are possible only if previously agreed.
Palm Grace Boutique guarantees that all products comply with the contract, stated specifications, expected quality, and Australian Consumer Law.
If a defect is found, consumers must report it within 30 days. Where possible, items should be returned in original condition.
Warranty does not apply to damage caused by misuse, unauthorised repairs, or external factors.
ACL (Australian Consumer Law) guarantees apply regardless of any additional warranty offered.
Delivery occurs to the address provided by the consumer.
Palm Grace Boutique ships orders with the utmost care and aims to deliver within the estimated timeframe.
If delivery is delayed or impossible, the consumer has the right to cancel the order and receive a refund.
If a replacement item is delivered, the consumer still retains the right to return it.
Orders may be shipped internationally. Shipping is free for customers.
However, Australian customs may charge GST, import duties, or clearance fees. These costs are not included in the product price and are the responsibility of the buyer.
Consumers will be notified by the courier or customs should fees apply.
Contracts with no fixed end date may be cancelled by the consumer at any time with a maximum notice period of one month.
Fixed-term contracts may be cancelled at the end of the contract period.
Automatic renewal is only allowed if the consumer can cancel at any time with one month’s notice.
Payment must be completed at the time of purchase.
Consumers must correct any incorrect payment information provided.
If payment is not completed, Palm Grace Boutique may charge additional costs if previously communicated.
Complaints must be submitted within 7 days of discovery, clearly described, and sent to Palm Grace Boutique.
We respond to complaints within 14 days.
If a complaint cannot be resolved together, a dispute exists.
If a complaint is justified, Palm Grace Boutique will repair or replace the item, or issue a refund.
ACL rights apply at all times.
All agreements between the consumer and Palm Grace Boutique are governed by Australian law, including Australian Consumer Law, regardless of the consumer’s country of residence.
